What are cookies?

Cookies are small text strings that the sites visited by the user send to their device (usually to the browser), where they are stored and then sent back to the same sites on the user's next visit. While browsing a site, the user may also receive on their device cookies sent by different sites or web servers (so-called "third parties"), on which certain elements (such as images, maps, sounds, specific links to pages on other domains) present on the site being visited may reside.

Based on their purpose, cookies are divided into "technical" cookies and "profiling" cookies:

They are not used for any further purposes and are normally installed directly by the owner or operator of the website. They can be divided into navigation or session cookies, which ensure normal browsing and use of the website (allowing, for example, a purchase to be completed or authentication to access restricted areas); analytics cookies, treated as technical cookies when used directly by the site operator to collect aggregated information on the number of users and how they visit the site; and functionality cookies, which allow the user to browse according to a series of selected criteria (for example, language, products selected for purchase) in order to improve the service provided. The installation of such cookies does not require the user's prior consent, although the obligation to provide notice under Article 13 of the Data Protection Code remains, which the site operator, if using only such devices, may provide in the manner it deems most appropriate.
  • Profiling cookies are those aimed at creating profiles relating to the user and are used to send advertising messages in line with the preferences expressed by the user while browsing the web. European and Italian regulations require that the user be adequately informed about their use and thus give valid consent. Article 122 of the Data Protection Code refers to them, stating that "the storage of information on the terminal equipment of a subscriber or user, or access to information already stored, is permitted only on condition that the subscriber or user has given their consent after being informed by the simplified means referred to in Article 13, paragraph 3" (Article 122, paragraph 1, of the Data Protection Code).

In terms of duration, cookies can be divided into "session" cookies and "persistent" cookies:

  • Session cookies are temporary and disappear from the computer when the user leaves the site visited or closes the browser. They are usually stored in the computer's cache memory.
  • Persistent cookies remain on the user's computer even after the browser is closed, until they expire or the user deletes them. The expiration date is determined by the site that sets them. They are often used to track user habits, so that when the user revisits the site, it reads the stored information and adapts to their preferences.

In terms of origin, cookies can be divided into "first-party" cookies and "third-party" cookies:

  • First-party cookies are those sent by the operator of the website the user is visiting.
  • Third-party cookies are those sent, via the website the user is visiting, by a party other than and different from the operator of the website the user is visiting.
